Getting Your Record Expunged in Minnesota
A criminal record can complicate your life in many ways. A criminal case can make it harder for you to get a job, get a place to live or obtain a professional license. In some cases, you can get a conviction expunged from your record.
Expungement is not available in every case, but if you qualify it can make a tremendous difference in your life.

The Criminal Expungement Process
Getting a conviction expunged from your record is not a simple process. If your conviction was for an offense that is eligible for expungement, and if you have maintained a clean record for the applicable amount of time, there is still no guarantee that your record will be expunged.
Once the forms have been completed and submitted, we must still demonstrate that the benefit to you of getting the expungement outweighs the public’s need to access that information. The court weighs several factors in making the determination, including:
- The severity of the crime
- How much time has passed since the crime was committed
- Any efforts you have made toward rehabilitation
- Any other criminal conduct on your record
- Why you are seeking an expungement
- Your employment record and community involvement
It is vital to present a compelling case for why you deserve to have your criminal record expunged.
The Benefits of Expungement
Just because getting an expungement is difficult does not mean it isn’t worth it.
The vast majority of Minnesota employers perform a background check before making hiring decisions. Even a non-violent misdemeanor conviction can be enough to end your candidacy for a job. An expungement can be the second chance you deserve.
